Income support replaces part of lost earnings
If a NSW motor accident injury reduces your earning capacity, you may be eligible for statutory income support. The insurer calculates the amount using pre-crash earnings, current earnings and your capacity for work.
To receive back pay from the accident date, SIRA says the claim should be lodged within 28 days.
The first 13 weeks
For the first 13 weeks, income support can be up to 95 per cent of pre-crash earnings. The actual amount depends on the insurer's calculation and any earnings you continue to receive.
From week 14
From week 14, income support can be up to 85 per cent of pre-crash earnings, depending on earning capacity. Ask the insurer for its written calculation and the capacity information it relied upon.
Later time limits
Statutory payments may end after one year for people at fault or mostly at fault, or for injuries classified as threshold injuries. Continuing income support after two years generally requires an ongoing loss of earning capacity and a damages claim. Individual circumstances differ, so confirm the applicable rule with the insurer or CTP Assist.
